1. Professional Marketing Services

Our client relationships are structured as collaborative, high-level engagements. To maintain your promised production timelines and ensure our standards of excellence are met, we work closely with you to gather necessary assets, including high-resolution product photos, website copy, administrative logins, and brand guidelines.

1.1 Forfeiture of Deposits

  • Reservation of Expertise: The commitment of an initial deposit or advance payment represents a formal, exclusive reservation of our specialized expertise, time, and production slot.
  • Cancellation or Stagnation: Should a project be terminated, cancelled, or stalled indefinitely for reasons caused by the client, any deposits or advance payments already paid will be forfeited to the agency. These funds directly cover the time our team has already spent on your project strategy, resource allocation, and the loss of opportunity cost for other global clients who could have utilized that production slot. Cash refunds are not provided under any circumstances.

1.2 The 30-Day Inactive Rule and Re-entry Fees

  • Active Status Protection: To protect our internal workflow and ensure that our active clients receive their deliverables according to scheduled deadlines, projects must move forward efficiently. If a client fails to provide the necessary assets, information, or feedback within 30 days of a formal request from our team, the project will be officially moved to Inactive Status.
  • Project Re-entry Requirements: To successfully move a project from Inactive Status back into our active production queue, the client is required to pay a Project Re-entry Fee equivalent to 20 percent of the original project price. This fee is a necessary administrative charge that covers the operational time required for our team to re-familiarize themselves with your project files, re-audit previously completed work, and perform the logistical task of refitting your project into our current high-demand production schedule.

1.3 The Sunset Clause

  • Contract Termination: If a marketing project remains in Inactive Status for more than six consecutive months without significant communication or the delivery of required assets, the contract between the parties is considered officially terminated.
  • Asset Archiving: In these cases, all payments made up to that point are forfeited in full, and the project files are permanently archived or deleted. This clause ensures our resources are always directed toward active, growth-oriented partnerships.

1.4 Strategic Credit Transfers

  • Flexibility to Pivot: While we do not offer cash refunds, we are deeply committed to the long-term success and satisfaction of our clients. In cases where a specific service was paid for but could not be rendered due to a valid shift in your business strategy or internal restructuring, your deposit may be transferred to a future service or an alternative project within our current scope of work.
  • Credit Expiration: This credit remains valid for a strict period of six months from the date of the original payment. If the credit is not utilized within six months, it will be considered expired. This allows you the flexibility to pivot your marketing efforts smoothly without losing the value of your initial investment.

2.1 Academy Sales and Educational Access

  • Final and Non-Refundable: All sales of professional training courses, specialized digital products, and extensive study notes are non-refundable. Due to the immediate and intangible nature of digital downloads and intellectual property access, there are strictly no refunds once a product or course cohort has been purchased or accessed via our student portal.
  • Reviewing Materials: Our educational products are not brief summaries; they are extensive, detailed guides that provide total clarity and actionable solutions. We encourage all students to review the comprehensive product and curriculum descriptions carefully to ensure the material meets their current learning needs before completing their purchase.

2.2 Intellectual Property and Academic Usage

Students and customers are granted a single, personal license to use these materials for their own personal or business growth.
  • Prohibited Sharing: Reselling, redistributing, duplicating, or sharing any Academy content, scripts, or materials with third parties or on public platforms is strictly prohibited. Any violation of this intellectual property clause will lead to the immediate termination of your course access without refund and may result in legal action to protect our proprietary educational assets.

These refund parameters and all professional relationships formed under them are governed by and construed in accordance with the Laws of the Republic of Kenya.
